Terms of Service

These Terms of Service ("Terms") govern your use of AgenticBoxes.email and its API (the "Service"), operated by Brian Becker, doing business as AgenticBoxes ("AgenticBoxes," "we," "us"). By creating an account, calling the API, or using the Service — including by directing an AI agent to do so on your behalf — you agree to these Terms.

1. The Service

AgenticBoxes provides programmatic email — sending, receiving, and managing email addresses ("boxes") — designed to be used by software agents through an HTTP API. Accounts are provisioned on a subdomain we host, on a domain we register for you, or on a domain you bring yourself.

2. Accounts, API keys, and agents acting for you

• You must provide a valid human owner email address for your account and keep it accurate. Account-critical notices are sent there.
• You are responsible for safeguarding your API keys. Any action taken with your keys — including by an autonomous agent you have authorized — is treated as taken by you and is binding on you.
• You are responsible for everything your agent does through the Service, including messages it sends, purchases it makes, and irreversible actions such as closing the account. We provide confirmation and protection controls (for example, domain-confirmation on account closure and optional owner approval); using them is your choice.
• You must be at least 18 years old and able to form a binding contract.

3. Acceptable use

You agree not to use the Service to:

• send spam, bulk unsolicited mail, or anything that violates anti-spam laws (including the U.S. CAN-SPAM Act);
• send unlawful, fraudulent, deceptive, harassing, or infringing content, or malware;
• impersonate others or send mail you are not authorized to send;
• attempt to breach, overload, probe, or circumvent the Service's security, rate limits, or other accounts' isolation; or
• resell the Service in a way that degrades deliverability or sending reputation for other customers.

To protect deliverability for everyone, we may rate-limit, suspend sending, or suspend an account that generates excessive bounces, complaints, or abuse signals.

4. Fees, credit, and taxes

• The Service is usage-priced and paid from prepaid credit you add to your account. Current pricing is shown on our site and may change prospectively.
• Charges are drawn from your credit balance as you use the Service. You are responsible for any taxes other than taxes on our net income.
• Payments are processed by Stripe; by paying you also agree to Stripe's terms. Refunds are governed by our Refund & Return Policy.

5. Domains

If we register a domain on your behalf, the year-one registration cost (and any renewal or DNS-hosting fees) is charged to you. Domain registration fees are paid to a third-party registrar and are non-refundable. The domain is yours; on account closure we will, at your request, work with you to transfer a domain you registered through us to a registrar account you control.

6. Your data and privacy

Our handling of your data — including the content of email you send and receive through the Service — is described in our Privacy Policy, which is part of these Terms.

7. Availability and warranties

We work to keep the Service reliable but provide it "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that email will always be delivered, that the Service will be uninterrupted, or that it will be error-free. Email delivery depends on third parties and the receiving systems, which are outside our control.

8. Limitation of liability

To the maximum extent permitted by law, AgenticBoxes will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability arising out of or relating to the Service is limited to the amount you paid us for the Service in the three months before the event giving rise to the claim.

9. Suspension and termination

You may close your account at any time through the API. We may suspend or terminate access for violation of these Terms, for abuse or security risk, or as required by law. On closure we make a data export available and revoke your API keys; see the Privacy Policy for retention and deletion.

10. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by a new effective date on this page and, where appropriate, notified to your account. Continued use after a change means you accept it.

11. Governing law

These Terms are governed by the laws of the State of Arkansas, USA, without regard to its conflict-of-laws rules. The exclusive venue for any dispute is the state or federal courts located in Arkansas, and you consent to their jurisdiction.
